The gratuities paid as a recommender will be considered by the Spanish tax authorities as a capital increase for the purposes of Personal Income Tax and Personal Income Tax. of non-residents. 7. After receiving the payment request, ShoppyClub will proceed to send the funds to the account within 30 days following receipt of the request; as long as there is no circumstance that prevents payment within the existing term.
8. Reward deliveries will be made by bank transfer, Paypal, Bizum, cryptocurrencies in euros to the account indicated by the Buyer or Interested Party in the Application and held by ShoppyClub.
9. When the rewards are discounts, or other types of goods, services or benefits, their delivery will be subject to the particular conditions established by the marketing company of the purchased product or contracted service.
10. ShoppyClub will be released from any obligation by transferring the amounts to the bank account you provided by the Buyer/Interested Party or by sending the code to access the discount or benefit, by ordinary mail or email, when possible, to the address indicated by the Buyer/Interest Party in their user registration.

ShoppyClub may, at any time, suspend or terminate the services offered through the Application, without this circumstance enabling the Buyer or the Interested Party to claim against ShoppyClub for any reason; beyond obtaining your rewards, in the manner provided for in these Terms and Conditions.
2. Likewise, these Terms and Conditions will cease to have effect:

3. Due to non-compliance with the obligations assumed by the Buyer .
3. In the event that the Buyer communicates his intention to unsubscribe from the Platform, ShoppyClub will proceed to delete their account and the Buyer will lose their right to obtain all pending rewards, whether they are in the validation process, validated or available to be claimed.

The Buyer/Interested Party exempts ShoppyClub from all liability, up to the maximum permitted by the Law, for all damages and losses that may be caused by causes not directly attributable to ShoppyClub or beyond its control, in particular and without this list being understood as limiting: (i) Force Majeure or fortuitous event, on which ShoppyClub could not reasonably have influenced; (ii) as a result of third party interference in the communication and transmission systems used by ShoppyClub or the Buyer; or (iii) due to malfunction or interruption of the services and/or the Platform due to fraud, fault, error or any type of act attributable to the Buyer or third parties; (iv) in case of loss or destruction of the data recorded in the Application; (iv) in the event that the transmission of data through the Application is not carried out correctly or is done incorrectly, inaccurate, incomplete, distorted or delayed. (v) derived from the existence of viruses, trojans or other malicious software elements.
2. Likewise, ShoppyClub's maximum liability arising from the execution of these Terms and Conditions will be limited, when permitted by Law, to the maximum amount of rewards received by the Buyer in the three months prior to the moment in which the harmful event occurs.

In this sense, ShoppyClub grants the Buyer a non-exclusive right of use of said content, although strictly limited to compliance with these Terms and Conditions. In no case will the Buyer have any additional rights over the creations of ShoppyClub or third parties made available to them as a result of the execution of these Terms and Conditions.
1. In the event that any of the terms of these Terms and Conditions of Use are illegal, invalid or ceases to be applicable, the rest of the conditions will continue to have effects.
1. These Terms and Conditions of Use will be governed by Spanish legislation, which will apply in what is not provided therein regarding interpretation, validity and execution.
